TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS AND CONDITIONS.

1.1. These Terms and Conditions refer to the use of the services offered by Hotel Territorio (Corporate Name: Atlas Patagonia S.A.) through the Internet site www.hotelterritorio.com.ar.

1.2. The use of the services by the client of Hotel Territorio implies full and unreserved acceptance by the client of each and every one of the clauses of these Terms and Conditions published on the website and Booking Engine. 

1.3. These Terms and Conditions shall constitute a valid and binding agreement between the customer and the Hotel Territorio in relation to the use of the services. 

1.4. The use of the services is subject to all notices, regulations, instructions, policies, terms and conditions present or that in the future may publish Hotel Territorio on the website.

1.5. Hotel Territorio may change the Terms and Conditions at any time by communicating in advance to the customer by publishing the new version on the website, and / or by email.

2. ROOM POLICY.

2.1 Maximum capacity of the Superior Suite category: 2 adults.

2.2 Maximum capacity of the Junior Suite category: 2 adults.

2.3 Maximum capacity of the Superior Room category: 2 adults.

2.4 Maximum capacity of the Family Room category: 2 adults + 2 minors up to 12 years old.

2.5 Maximum Capacity of the Superior Triple category: 3 adults + 1 child up to 12 years of age with additional bed.

2.6 Extra bed for children under 12 years of age in Triple room only and with additional cost.

2.7 Extra crib for children under 2 years old free of charge.

2.8 Extra Bed and Extra Crib are not implemented simultaneously in the same room.

3. PET POLICY.

3.1. For security and tranquility reasons, Hotel Territorio does not allow the entry of any type of pet and/or domesticated animals.

4. ONLINE BOOKING SERVICE.

4.1. This is an Internet site through which Hotel Territorio provides hotel services through the exclusive publication for its customers of the online booking service.

4.2. The service includes the rooms that will be published on the website for a period of time, and that, once booked, must comply with the procedures and business guidelines set forth in these Terms and Conditions.

4.3. The publication service may be complemented by sending Newsletters, with the publications, to the email address indicated when registering as a customer in the Newsletter service and / or any marketing or advertising action, whether online, for example, social networks, email, Internet or any other computer media or by conventional mail, print advertising, television, radio, telephone, text messaging or multimedia telephone, and / or by any means of communication that Hotel Territorio deems appropriate.

5. ACCESS AND USE OF SERVICES

5.1. The services of Hotel Territorio are publicly accessible and for those customers who have previously made an online reservation on the website, under these Terms and Conditions, its amendments and versions and other present and future provisions.

5.2. The customer must be over 18 years of age and not be under any legal or factual impediment to contract. Failure to comply with this clause shall render void any act performed by the customer without the right of the latter to any claim and shall entitle Hotel Territorio to initiate appropriate legal action against him or against whoever is responsible (parents, guardians, caregivers or curators).

5.3. The customer may purchase the services through the site, transferring the sums of money that apply through the means of payment authorized by Hotel Territory.

Hotel Territorio reserves the right to unilaterally modify the presentation and configuration of the services offered, as well as the conditions required to use them.

6. PROTECTION OF PERSONAL DATA.

6.1. Hotel Territorio offers strict confidentiality, security and protection of the information provided by the customer, complying with all applicable laws and provisions, mainly with the provisions of the Personal Data Protection Act No. 25,326 and its regulations, with those contained in art. 25 thereof, art. 9, on security measures and art. 10 referring to the confidentiality of data. For such purpose, the following e-mail address is available: ventas@dot-hotels.com, where you will receive assistance in case of any concern related to the processing of third party data and information.

6.2. The Privacy Policy is based on: i) The Personal Data base that is formed will not have purposes contrary to law or public morality.  The data or customer information will be used exclusively to send information related to commercial and business activity related to the services provided by Hotel Territorio; ii) The collection of Personal Data will take the utmost care to ensure that they are true, adequate, relevant and not excessive in relation to the scope and purpose for which they are requested; iii) Personal Data will be collected only through fair, clear, transparent means and in accordance with the legal provisions; iv) Personal Data will be used for the purposes indicated in this Privacy Policy; v) It is ensured that the data provided by the client are always accurate and remain up to date. To this end, you are invited to proceed to its modification or deletion, whenever necessary; iv) The storage of Personal Data will be done in such a way that the customer can access them, in exercise of the rights granted by the laws of their jurisdiction or this Policy; vii) Personal Data will be treated in a framework of strict confidentiality, as well as the suppliers that are part of Hotel Territorio in the provision of services, both during the term of the contract or the provision of the service and once completed, without time limit. Personal Data will only be disclosed in cases where it is mandatory and under the conditions of lawfulness legally established; viii) By accepting the Terms and Conditions, the customer expressly authorizes to collect, process, store, share and / or treat your Personal Data provided, as provided in this Privacy Policy and the Personal Data Protection Act No. 25. 326 and regulatory provisions; ix) In case of not accepting these Terms and Conditions, the client shall refrain from making a reservation; x) Once the required data has been provided, the client may exercise the right to access the information, rectify, update and delete his/her Personal Data in accordance with the provisions of this Privacy Policy and in accordance with the Personal Data Protection Law No. 25. 326 and regulatory norms; xi) At any time the client shall be entitled to request a copy of the information about him/her that he/she has provided within the scope of these Terms and Conditions. In case of requesting a copy, an e-mail should be sent to ventas@dot-hotels.com; and xii) The client has the right to request that his/her Personal Data not be used for advertising promotion purposes. To change the advertising preferences or unsubscribe, the customer may send an e-mail for such purposes to ventas@dot-hotels.com. 

6.3. The promotional actions of Hotel Territorio comply with the Personal Data Protection Law No. 25,326, Article 27 which states: "The holder may at any time request the withdrawal or blocking of his name from the data banks referred to in this article" and Decree 1558/01, article 27 which provides: "In any communication for advertising purposes made by mail, telephone, e-mail, Internet or other remote means to be known, it must be indicated, expressly and prominently, the possibility of the data holder to request the withdrawal or blocking, in whole or in part, of his name from the database. At the request of the data subject, the name of the person in charge or user of the database who provided the information shall be informed".  

ACQUISITION OF A SERVICE.

7.1. The client who wishes to purchase a service "Purchasing User" must declare his willingness to reserve, by clicking on the "Confirm Reservation" button, and must complete the data required during the reservation process.

7.2. Reservations are Nominal and non-transferable At the moment of contracting the lodging service, all the guests that will use the service must be identified. The following information is required: a) Full name and last name. b) Nationality. c) Country of residence. d) Identity card number or passport number if foreigner and a legible copy of the same. The fulfillment of this requirement shall be exclusive to validate the Service Reservation.

7.3. The User shall be solely responsible for the information provided during the booking process, not being Hotel Territorio responsible for errors, omissions and / or falsity of it.

7.4. Hotel Territorio will make every effort to meet the demand for rooms by customers. Notwithstanding the foregoing, in case of cancellation of the purchase of a room, it must be reported to Hotel Territorio via email to ventas@dot-hotels.com

7.5. Payment Methods will be those determined by Hotel Territorio at its discretion and that are available at the time of booking, being able to modify, delete, or combine them in the future. They will be determined according to the marketing channel chosen, being these:

a) Direct channel: enabled credit cards, digital electronic means, bank transfer to ATLAS DE LA PATAGONIA's account.

b) Agency channel: bank transfer to ATLAS DE LA PATAGONIA's account.

c) Digital Channel: bank transfer to the account of ATLAS DE LA PATAGONIA.

7.6. Any discrepancy, error, omission and/or inconvenience related to the system, form and/or entity of payment, and not attributable to Hotel Territorio, shall be the sole responsibility of the acquiring clients and/or the payment entities, as the case may be.

7.7. Under no circumstances will Hotel Territorio receive any payment by any means other than by the Payment Method(s) established.

7.8. Upon receipt of the transfer of the Price of the service purchased, Hotel Territory will send the customer, via email to the account informed during the booking process, a confirmation containing the following information:

1. a) Name and/or Company Name of the Hotel;

2. b) Details of the service purchased.

7.9. The price of the rooms does not include in-room expenses. In those cases in which the expenses have to be charged apart from the price of the room, the amount of the same will be specified and the client will be notified before making the reservation.

7.10. Hotel Territorio reserves the right to change its prices at any time, but the services will be billed based on the rates in effect at the time of registration of reservations and according to the availability of the requested service.

7.11. The services will remain reserved to the client until the payment of the reservation is made according to the cancellation policy. If the reservation is not prepaid in a timely manner, it will be canceled without notice.

7.12. Hotel Territorio reserves the right to refuse a reservation of any user with whom it has a dispute.

8. CANCELLATION POLICY.

Hotel Territorio establishes the following cancellation policy according to the contracting channel:

(a) Direct Channel: cancellation policies are subject to the selected rate. Being these: 

i. Non-Refundable Rate: It does not allow date changes or cancellations. 100% of the stay is charged in advance.

ii. Flexible Rate: Reservations may be cancelled without penalty up to 16 days prior to check-in date. Within 15 days a one night penalty is charged. Date changes are subject to availability and may imply changes in the rate.

b) Agency Channel: no penalty up to 16 days prior to the check-in date, i.e. without counting the check-in date. Within the 15 days mentioned above, the penalty will be the equivalent of one night. Date changes are subject to availability and may imply changes in the Rate.

c) Digital Channel: according to the Terms and Conditions established by ATLAS DE LA PATAGONIA with each particular Digital Channel.

d) ATLAS DE LA PATAGONIA reserves the right to cancel any Sale or Reservation with 6 months notice, without prior notice and communicating the same by e-mail to the mail informed at the moment of receiving the payment.

e) In all the Channels, in case the Guest does not show up on the arrival date, the Service will be considered as effectively used.

9. OBLIGATIONS OF THE CLIENT.

The customer agrees to use the services in accordance with the law, these Terms and Conditions, as well as morality and decency and public order. The customer agrees to refrain from using the services for illegal purposes or effects, harmful to the rights and interests of Hotel Territorio, other users and / or third parties, or in any way damage, disable, overburden, or impair the services, or prevent the normal use of the same by all of the above.

9.2. The customer agrees to refrain from any of the following acts, being the same expressly prohibited: a) Smoking within the space of Hotel Territorio. Being a "Smoke Free" Hotel in the rooms and common areas of Hotel Territorio no smoking is allowed, in accordance with the provisions of national law. In the event that a customer smokes in any area of Hotel Territorio, will be charged with the title of Cleaning, an amount equivalent to 20% of the daily rate plus V.A.T. as a penalty; b) Use of the Hotel Territorio's facilities for smoking. A as a penalty; b) Use the services directly or indirectly, to violate any applicable law, whatever its nature, whether provincial, national or international, send or transmit sexual or obscene material, pornographic, or in violation of any applicable law, national or international, or morality, decency, or public order; transmit, distribute, or store any information, data or materials that violate provincial, national or international laws or regulations; post or transmit information whose content is, directly or indirectly, and without limitation, infringing, profane, abusive, defamatory and/or fraudulent, or which discloses private or personal matters affecting any person, or otherwise violates the rights of others; access the Services using a false, misleading or non-existent name, whether as a natural or legal person; post or transmit any material that the Customer has no right to transmit under any law (whether copyright, trademark, trade secret, patent or other proprietary rights of others but not limited to) or under contractual or fiduciary relationships (such as non-disclosure agreements); c) violate or tamper in any way with the authentication, identity verification and security systems of the Services, networks or accounts of Users, administrators and/or service providers; and not limited to, attempt to access data not intended for the User, attempt to access the Services or accounts without express authorization to do so, or attempt to test or alter in any way and at any level the security of the networks of Hotel Territorio, using any kind of tools that serve the same or similar purposes; attempt interruptions, variations or cuts in Internet communications, such as altering routing information, derivation and / or distribution, deliberately overload one or more services (overflow or similar), make computer attacks on other computers on the Internet or other type of computer communications network, global, local and / or internal, among others; adulterate the advertisements included on the website or any other Internet site allied and / or associated with Hotel Territorio; use any program, command or group of commands, or send messages of any kind, intended to interfere with the session established by a user at any point on the Internet; carry out any type of monitoring that involves the interception of information not intended for the User; send or transmit files containing viruses or other destructive features that may adversely affect the operation of a computer of others and / or may affect the proper functioning of the same and / or the Services; use any computer program (software) or other means, which induces deception, in order to increase or seek patrimonial or commercial advantages in favor of the User or third parties not authorized by Hotel Territorio or not provided for in these Terms and Conditions; perform actions that restrict, deny or prevent any individual, group, entity or organization the use of the Services, and the Internet in general. Also, the use of any method or system, computer or not, by the user and / or third parties in favor of it for the purpose of using the Services, which are not expressly authorized by Hotel Territorio in these Terms and Conditions and / or other express means, is prohibited and shall be grounds for sanctions and / or procedures provided therein, without prejudice to legal actions that Hotel Territorio and / or its representatives and / or successors may bring for that purpose.

9.3. Visitor Registration: Without exception, any person visiting the client who wishes to access common areas or the room must first and compulsorily register at the reception desk.

9.4. Coexistence guidelines for guests and groups: It is necessary to preserve that all hotel guests can enjoy a pleasant experience, which is why it is required to respect healthy rules of coexistence, namely, to measure and avoid noises that may be annoying or activities that may disturb the rest or relaxed stay of other guests. This applies to both rooms and common areas, requesting to control the consumption of alcoholic beverages and the number of visitors. It should be considered that failure to comply with these specifications or others stipulated in the internal regulations of Hotel Territorio could result in the request for immediate eviction of the client, without the right to any refund, in order to ensure a pleasant experience for the rest of the guests. Hotel Territorio prohibits the stay in a state of drunkenness, prohibits the use of drugs, dangerous substances, the use of weapons, disturbing noises, shouting, circulation with the naked torso, the stay of people with suspected contagious diseases or people with suspicious attitudes.

9.5. Food and beverages: it is not allowed the entry of food and beverages without the express authorization of any of the representatives of Hotel Territorio.

10. NEWS / NEWSLETTER.

10.1. The Newsletter service consists of sending e-mail to the address registered by customers, with information about the services published on the website of Hotel Territorio, as well as possible promotions in force, news and / or relevant information.

11. SECURITY.

11.1. All commercial transactions will be conducted through the platforms of Hotel Territorio, enabled Credit Cards and other means of electronic payment. Your information is secure on all platforms mentioned.

12. CHECK-IN AND CHECK-OUT.

12.1. The hours of Entry and Registration (check-in) at Hotel Territorio is from 15:00 hours and check-out (check-out) until 11:00 am.

12.2. Subject to availability, there is the option of paying an extra cost of 30% of the rate paid for late check-out until 15:00 hours. After that time, the full rate will be added.

12.3 Documentation: All guests must show their ID card, passport or identity card at check-in. This policy also applies to minors. Minors: It is mandatory to register and present photo identification for minors. It is also necessary for the guardian accompanying them to present proof of documentation in the form of a public deed at the hotel's registry.

13. LIABILITY.

13.1. The customer understands and accepts that Hotel Territory may not be held liable for breach of contract, in case of unavailability of a room due to force majeure, disruption, total or partial strike, in particular of electricity, gas, and / or communications, flood or fire.

13.2. Control of access and movement of people. Hotel Territorio undertakes to make reasonable efforts to control the entry and exit of customers and guests, users of the various services provided in its facilities, and their movement, all in order to safeguard the overall safety and ensure the best experience of our customers. However, it may not be held responsible for any undesired situations that may occur, which shall be attributable to the persons directly involved in the events.

13.3. Loss, theft, loss and theft: The customer declares that Hotel Territorio will not be responsible for the loss of money and / or personal belongings of material and / or emotional value. The customer has a safe in each room.

13.4. Damage, breakage and / or theft of any item, accessory, and / or equipment that is verified in the rooms or common areas of Hotel Territorio as a result of improper use or responsibility of the customer, shall be subject to the charge of a penalty equivalent to the full replacement value and placed at the home of the hotel of the damaged, unused or lost property, reserving Hotel Territorio the right to debit that value of the credit card used to make the reservation. 

14. HEALTH PROTOCOL.

14.1. Hotel Territorio has developed the Protocol COVID-19 governed by the recommendations of the Ministry of Tourism and Sports of the Nation in conjunction with the Institute of Tourism Quality Argentina (ICTA), the Argentine Chamber of Tourism (CAT), the Association of Tourist Hotels (AHT), the Association of Hotels, Restaurants, Confiterías y Cafés (AHRCC), the Federación Empresarial Hotelera Gastronómica de la República Argentina (FEHGRA), and the provinces through the Consejo Federal de Turismo, which the clients declare to know and undertake to comply with, being mandatory and forming part of these Terms and Conditions.

15. JURISDICTION AND APPLICABLE LAW.

15.1. The present contract is governed by the laws of the Republic of Argentina.

15.2. Any dispute arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the ordinary courts of the Autonomous City of Buenos Aires, Republic of Argentina.
